US Court Mandates Freedom of Abrego Garcia from ICE Custody

Courtroom scene

A court has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks lawful basis.

"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.

The situation originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an mistake. After his return to the United States to face human smuggling allegations, he was held in federal custody.

In her decision, the judge noted that the government does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The court proceedings center on conflicting claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in the state of Tennessee.

Terms of Freedom

The judge, who was overseeing his petition to deportation in a Maryland district court, determined that he must now adhere to the terms of his release from jail in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.

This decision marks a significant turn in a complex immigration battle involving allegations of mistaken imprisonment and disputed criminal affiliations.
